The ALSAD SPORT Mobile and Web Application (hereinafter: the “Application”), the Website, and all related content are owned and operated by NETIS Ltd(Company Registration Number (EUID): HUOCCSZ.01-10-046495; VAT ID (EU): HU14945375; Registered Office: HU1134 Budapest, Váci út 45., Hungary), as the parent company, and its subsidiary ALSAD Medical Ltd. (Company Registration Number (EUID): HUOCCSZ.01-09-414690; VAT ID (EU): HU26684802; Registered Office: HU1134 Budapest, Váci út 45., Hungary, hereinafter collectively: “ALSAD Medical”). ALSAD Medical holds all ownership and operational rights, including system operation and maintenance.

By accessing the Website or using the Application, you (“End End user”) agree to be legally bound by these Terms of Use, which become effective immediately upon your first visit to the Website. Please read the following terms carefully before using the Website or the Application to understand your legal rights and obligations.
By accessing or using the Website and the Application, you expressly acknowledge and agree that your legal relationship is established with ALSAD Medical Ltd..

By visiting and browsing the Website or using the Application, every End user agrees to use them at their own risk and responsibility, in accordance with these Terms of Use. End users also acknowledge that they must comply with the provisions contained herein, as well as with the Privacy Policy, the Cookie Policy, and all applicable laws and regulations.
By using the Website and the Application, you voluntarily consent to these Terms of Use and to the processing of certain personal data as specified in the Privacy Policy. If you do not agree to these Terms, please do not use the Website or access your End user account.

The purpose of this Website is to provide general information about the ALSAD SPORT Application, its features, services, and usage possibilities.

ALSAD Medical reserves the right to unilaterally modify these Terms of Use at any time, without prior notice, in compliance with applicable laws, by updating this publication.

In accordance with UK and EU legal regulations on capacity, the Website and the Application are intended only for persons aged 14 years or older. Individuals who are legally incapable (e.g., minors under 14 years old) are not permitted to use or visit the Website or the Application.

Persons with limited legal capacity (e.g., minors over 14 years old who are not fully capable) may access and use the Website and the Application only with the prior consent of their legal representative (parent, guardian, or custodian).

Access to and use of the Website and the Application are subject to compliance with these Terms of Use, the General Terms and Conditions, and all applicable laws and regulations of Hungary.

The Website and the Application are the exclusive property of ALSAD Medical. All content available on the Website and within the Application, including but not limited to materials, trademarks, logos, and domain names, are protected by intellectual property laws and remain the sole property of ALSAD Medical. Only ALSAD Medical is entitled to grant any license or right of use in relation to such content.

Use of the Website and the Application is permitted only to the extent allowed by law, including the provisions of Chapter IV of Act LXXVI of 1999 on Copyright (Fair Use). Accordingly, Users may download parts of the Website or Application content to their personal computer or device solely for private, non-commercial use, provided that they respect all statutory limitations on the use of intellectual works and comply with other applicable legal requirements.

The User’s right of use is limited, non-transferable, and non-assignable.

Consequently, the End user is not entitled to:

a) copy, distribute, modify, or otherwise use any part or the entirety of the Website or the Application without the prior written consent of ALSAD Medical, including, but not limited to, reproduction, distribution, public performance, communication or retransmission to the public, adaptation, or exhibition;

b) use, modify, create derivative works from, transfer (by sale, resale, license, sublicense, download, or otherwise), reproduce, distribute, display, or republish the ALSAD SPORT Application for any commercial or public purpose, except where expressly authorized in writing by ALSAD Medical;

c) interfere with the servers or networks connected to the Website;

d) use or launch any automated system (including, without limitation, “robots,” “spiders,” or similar technologies) to access the Website;

e) circumvent, disable, or otherwise interfere with any security-related features of the Website (including features that prevent or restrict the use or copying of content or that enforce limitations on Website use); or

f) modify any settings or content of the Website, unless such modification is explicitly permitted by the Website itself.

Violation of the above provisions may result in legal consequences. ALSAD Medical reserves the right to take any necessary measures to enforce its rights, including legal proceedings and the recovery of any damages incurred.

The User acknowledges and agrees to bear full liability for any damages caused to ALSAD Medical arising from or in connection with the use or misuse of the Website or the Application, or from any breach of these Terms of Use.

Content and trademarks:

a) The entire content of the Website and the Application, including, without limitation, texts, documents, articles, brochures, descriptions, products, software, graphics, photographs, audio and video files, interactive features, functions, and services (collectively referred to as the “Content”); and

b) The trademarks and logos contained therein (the “Trademarks”) are the exclusive property of ALSAD Medical and/or its licensors, and are protected by applicable copyright laws, intellectual property legislation, and international treaties.

The names “ALSAD”, “ALSAD SPORT”, the ALSAD logo, and other related marks are owned by ALSAD Medical or its affiliated entities.

All other trademarks and logos displayed on the Website are the property of their respective owners and are afforded the same level of protection as the ALSAD name and logo.

ALSAD Medical reserves all rights not expressly granted in any bilateral agreement or within the Website and its Content.

Any use of the Content or Trademarks — in whole or in part — is strictly prohibited without the prior written authorization of the respective rights holder.

Use of Content: The Website is provided solely for the purpose of informing End users for their personal use.
Any use of the Content, whether in whole or in part, shall be entirely at the End user’s own risk and responsibility.

Use of the Content outside the Application — in particular downloading or printing copies — is permitted only with the prior written consent of ALSAD Medical. Even with such consent, all copyright notices, proprietary rights legends, and any other legal designations included in the Content must be preserved and properly referenced as protected.

ALSAD Medical makes every reasonable effort to ensure that the information provided on the Website and in the Application is accurate, up to date, and reliable.

However, ALSAD Medical does not warrant the accuracy, authenticity, completeness, or timeliness of any Content available on the Website or within the Application, and to the fullest extent permitted by law, expressly disclaims any and all liability related thereto.

ALSAD Medical shall not be held liable, whether in contract, tort, or otherwise (except in cases of willful misconduct or gross negligence), for any damages arising in connection with the content of or access to the Website, including but not limited to:

• inaccuracies or omissions in the information or materials provided on the Website or in the Application;
• damages resulting from unauthorized intrusion leading to alteration of information or materials;
• or, in general, any loss or damage — regardless of cause, origin, or consequence — arising from:

(i) access or inability to access the Website;
(ii) use of the Website or Application that results in infection of the User’s computer or device with a virus; and/or
(iii) reliance on any information provided, directly or indirectly, through the Website.

This limitation of liability does not exempt ALSAD Medical from complying with applicable Hungarian, UK or EU laws and regulations.

ALSAD Medical reserves the right to modify, enhance, or otherwise change the content of the Website and the Application at any time, without prior notice.

By using the Website and/or the Application, the User acknowledges and agrees that the content provided does not constitute medical advice, diagnosis, or treatment, and should not be relied upon as a substitute for professional medical consultation.

The User agrees to comply with all applicable laws, regulations, and legal requirements when using the Website and the Application.

ALSAD Medical expects all Users to respect the law, as well as the rights and dignity of others.
The Website and the Application must not be used:

• in any manner that violates applicable laws or regulations;
• for unlawful or fraudulent purposes, or with any intent or effect of committing such acts;
• for the purpose of causing harm or attempting to cause harm, or infringing upon the lawful rights or dignity of others;
• to impersonate another person or legal entity — including, without limitation, representatives of ALSAD Medical;
• to transmit or send unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation;
• to frame or mirror any part of the Website;
• to create or compile a database by systematically downloading and storing Website content;
• to transmit, upload, or otherwise distribute any data or materials containing viruses, Trojan horses, worms, spyware, adware, or other malicious software or computer code designed to interfere with, disrupt, or damage the operation of computer software or hardware;
• or to gain unauthorized access to the Website, the server on which it is hosted, or any server, computer, or database connected to the Website.

In the event of any breach of these rules, ALSAD Medical reserves the right to report the violation to the competent law enforcement authorities and will cooperate by disclosing the identity of the offender if requested.

It is strictly prohibited to use the Website or the Application for any activity, act, or condition that violates the law.

If ALSAD Medical becomes aware of any activity that violates these Terms of Use — including the posting, transmission, or distribution of any information or material that breaches these provisions — ALSAD Medical reserves the right to remove or disable access to such content and to terminate the End user’s access to the Website or Application with immediate effect.

Furthermore, ALSAD Medical reserves the right to disclose the End user’s identity to third parties who claim that any content posted or uploaded by the End user on the Website or in the Application infringes their intellectual property rights, privacy, or other legitimate interests.

Except as expressly provided in the General Terms and Conditions, access to and use of the Website is currently free of charge.

However, ALSAD Medical reserves the right to introduce fees for certain types of access or use in the future.
Any such payment obligation shall be subject to the User’s prior consent.

In the event that the User does not consent to or fails to make payment, ALSAD Medical reserves the right to suspend or revoke all or part of the User’s access rights to the Website or the Application.

The Website may contain links to, or enable End Users to post content on, third-party websites that are not owned or controlled by ALSAD Medical.

ALSAD Medical has no affiliation, control, or responsibility over the content, privacy policies, or practices of any third-party websites.

The End User:
a) assumes sole responsibility for accessing and using any third-party websites or links, and for any content they may submit to or publish on such third-party websites; and
b) expressly releases ALSAD Medical from any and all liability arising from the use of any third-party website. Accordingly, we recommend that Users carefully review the terms, conditions, and privacy policies of any external websites they choose to visit.

ALSAD Medical permits linking to its Website under the following conditions:

a) the link refers to a single page of the Website and does not create or store a copy of it;
b) the hyperlink text must accurately describe the Content as it appears on the Website;
c) the link must not misrepresent the User’s relationship with ALSAD SPORT or ALSAD Medical, nor convey false or misleading information about ALSAD Medical or its services; nor may it imply endorsement of any product or service without ALSAD Medical’s prior written consent;
d) no link may originate from a website (“third-party site”) that prohibits outbound linking;
e) such third-party sites must not contain content that:

i. is offensive or controversial (as determined at the sole discretion of ALSAD Medical); or
ii. infringes upon any person’s or entity’s intellectual property rights, personality rights, privacy, or other legal rights; and

f) the User and their website must comply with these Terms and all applicable laws and regulations.

Any personal data lawfully collected or accessible through the Website or Application with the End user’s consent shall be processed in accordance with the applicable Privacy Policy and Cookie Policy of ALSAD Medical.

The User acknowledges that:

(i) it is technically impossible to ensure that the Website and the Application will operate without interruption or error at all times, and ALSAD Medical shall not be held liable for such interruptions or errors;
(ii) such errors may result in temporary unavailability of the Website or the Application; and
(iii) the operation of the Website may be adversely affected by circumstances beyond the control of ALSAD Medical — including, but not limited to, transmission or telecommunication issues between ALSAD Medical’s systems and the End user’s (or third-party) networks.

ALSAD Medical and/or its contractual partners may, from time to time, modify, suspend, or discontinue the availability of the Website, the Application, or parts thereof — either temporarily or permanently — in order to carry out maintenance, improvements, or updates.

ALSAD Medical shall not be liable for any damages arising from such modifications, suspensions, or discontinuations of availability.

In any case, the total aggregate liability of ALSAD Medical for damages arising from or related to the use of, or inability to use, the Website or the Application shall not exceed the total amount of fees (if any) paid by the End user to ALSAD Medical during the three (3) months preceding the filing of such claim.

These Terms shall remain in effect until withdrawn or terminated by ALSAD Medical, or until the End user ceases use of the Website or the Application.
ALSAD Medical may, at its sole discretion and at any time, with or without cause (including, but not limited to, a breach of these Terms), suspend or terminate the End user’s access to the Website, the Application, or any portion thereof.
ALSAD Medical shall not be liable to the End user or any third party for any such termination or suspension.
If the End user objects to these Terms, any of their modifications, or becomes dissatisfied with the Website or the Application in any way, the End user shall have no right to assert any claim on this basis. In such cases, the End user must immediately discontinue use of the Website and/or the Application.
Upon termination, the End user’s right to access or use the Website and/or Application shall cease.
Provisions relating to intellectual property rights, data protection, limitation of liability, and relationship of the parties shall survive termination.

The End user and ALSAD Medical are independent legal entities.
Nothing in these Terms shall be construed as creating a partnership, joint venture, employment, or agency relationship between the User and ALSAD Medical.
Under no circumstances is the End user authorized to represent ALSAD Medical, make any warranties, statements, or assume any obligations or rights on its behalf.
These Terms, and any rights or licenses granted under them, may not be assigned or transferred by the End user.
ALSAD Medical, however, may assign these Terms, in whole or in part, without restriction or prior notice to the End user.

By accessing the Website, the End user agrees that any dispute or claim arising out of or relating to the use of the Website shall be governed by the laws of Hungary.
The courts of Hungary shall have exclusive jurisdiction over any such disputes.
